10.2 Both parties will be released from their respective obligations if a party is prevented from performing its obligations for any reason beyond its control, including if Kenny Waste Management`s waste management license is revoked or modified to prevent Kenny Waste Management from performing this Agreement. 1.2 This Agreement constitutes the entire agreement between the parties with respect to the Service, supersedes all prior agreements regarding the Service and supersedes all terms provided by the Customer or implied by law, use of trade, practice or course of business. 6.5 The Customer shall reimburse Kenny Waste Management for its costs wasted in connection with the planned services not provided by Kenny Waste Management because the Customer does not provide access in accordance with clause 6.1.1 „Wasted Costs“ includes administrative costs, attendance fees, lost profits; Staff time and any other costs, expenses or losses that Kenny Waste Management can prove result from the Customer`s failure to grant access. 5.5 Any collection in excess of those mentioned in Part A or additional services agreed to by Kenny Waste Management will be charged in addition to the fee (at Kenny Waste Management rates applicable from time to time). 8.4 Kenny Waste Management can in no way be held responsible for any loss of profit or anticipated savings; loss or damage to reputation or goodwill; loss of opportunities; loss of management or other staff time; losses or liabilities arising out of or in connection with any other contract; in any case, whether direct, indirect, special and/or consequential damages; or for other indirect, special and/or consequential damages. WASTE: Wastes that are not hazardous wastes (as defined in the EPA). 5.4 The maximum period is 14 days for „no account“ customers and 28 days for „account customers“. It is the responsibility of the tenant to request the collection within the time limit. Otherwise, an unexpected pick-up and/or rental fee of £3.50 per day for roll-on/offs and £1.50 per day for all skips will apply, unless agreed in section 2 of the service contract. .
